Terms and Conditions

These Terms and Conditions ("Terms") apply to all offers, orders, agreements, and the use of services and the website of Polagro ("we", "us", "our") and the customer ("you", "your"). By using our website, creating an account, or placing an order, you agree to these Terms. Any deviating or additional terms proposed by you are only binding if we have accepted them in writing.

Polagro supplies sustainable biomass, including sunflower husk pellets, to business customers. We provide quotes, process orders, and deliver by truck load. Product specifications, quantities, and delivery terms are as agreed in the order or quote. We reserve the right to refuse orders and to limit quantities.

A contract is formed when we confirm your order or quote in writing (including by email). You are responsible for the accuracy of the information you provide. We may request additional identification or documentation for compliance and fraud prevention.

Prices are in EUR unless otherwise agreed, exclusive of VAT and other taxes where applicable. Payment terms are as stated in the invoice. We may charge interest on overdue amounts in accordance with applicable law. In case of default we may suspend further deliveries.

To the extent permitted by law, our liability is limited to direct damage and shall not exceed the amount paid by you for the relevant order in the twelve months preceding the claim. We are not liable for indirect damage, loss of profit, or consequential loss. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g. EU consumer rights where applicable).

We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable national law. We use your data to perform the contract, send account-related and transactional communications, and, if you have consented, to send marketing and newsletter communications. You have the right to access, rectify, erase, restrict processing, and to data portability, and the right to object and to lodge a complaint with a supervisory authority. These Terms are governed by the laws of Poland. The courts of Poland have exclusive jurisdiction over any disputes, unless mandatory consumer law in your country requires otherwise.
